Terms & Conditions

By engaging with Blessed Birth Haven (BBH), you (“Client”) agree to these Terms & Conditions:

1. Scope of Services

​​

We provide private-duty labor & delivery RN services, doula and postpartum support in client's preferred delivery location, including home, hospital, and birth center. RNs are licensed under Chapter 464, Florida Statutes, and operate under the Nurse‑Practice Act. We do not provide emergency care, surgical procedures, medical diagnosis, or prescriptions.

  • Independent RNs may contract directly in private homes per Chapter 400.464(5)(a) F.S.

  • We do not perform duties requiring home-health agency licensing unless we are licensed or contracted through such agency.

2. Licensing & Contractor Status

​​

  • All RNs hold valid Florida licenses (Chapter 464 F.S.) and may contract directly with clients.

  • Should we act as a nurse registry, we comply with Chapter 400.506 F.S., including background checks, HIV training, and emergency planning for contractors.

3. Client Obligations & Acknowledgments

​​​

Clients must:

  • Retain a physician or midwife for all prenatal and delivery care.

  • Provide informed consent and timely disclosure of relevant health conditions.

  • Understand we may decline or suspend services if home conditions jeopardize safety or violate agreed protocols.

4. Informed Consent & Authorization

​​​

  • All services are conducted under voluntary, informed consent.

  • Nurses shall comply with documentation requirements under Florida Medicaid rules (59G‑4.261), when applicable.

5. Liability & Indemnification

​

Clients agree to:

  • Hold harmless Blessed Birth Haven, its RNs, and staff from liability for outcomes influenced by delayed or declined medical intervention.

  • Acknowledge that our RNs operate within legal scope and cannot guarantee delivery outcomes.

Free Birth / Unassisted Birth Disclaimer

If the client chooses to pursue an unassisted birth (commonly referred to as a “free birth”)—that is, a birth without the presence or supervision of a licensed medical professional such as a physician or midwife—they do so at their own risk and with full understanding of the potential dangers associated with unattended labor and delivery.

Blessed Birth Haven, its nurses, doulas, employees, volunteers, and affiliates are not liable for any complications, injuries, or outcomes resulting from a planned or unplanned free birth. By proceeding with our services, you agree to hold Blessed Birth Haven harmless and release us from any claims or legal action related to adverse maternal or neonatal outcomes during an unassisted delivery.

Clients are encouraged to seek the care of a qualified licensed medical provider for all prenatal, intrapartum, and postpartum needs. Our staff can offer support and guidance, but this does not replace the necessity of licensed medical oversight during childbirth.

6. Booking, Fees & Payment Terms

​​

  • A non‑refundable deposit of 50% is due upon contract signing.

  • Remaining balance due on the day of birth immediately upon arrival at the client’s home or hospital (unless otherwise agreed).

  • All fees are non-refundable once labor support begins at the first contact.

  • Additional services (postpartum, lactation consultation, education) are billed separately.

7. Cancellation, refunds, & Substitution Policy

​​

  • If the client chooses to cancel services after the contract is signed:

  • More than 30 days before the estimated due date: No additional payment is required, but the deposit is forfeited.

  • Within 30 days of the estimated due date: Client remains responsible for the full-service fee, regardless of whether services are used

  • If Blessed Birth Haven (RNs or Doulas) do not arrive in time due to a precipitous delivery, and no delay on their part, the remaining balance must still be paid. (Please refer to the arrival policy)

  • If Blessed Birth Haven (RNs or Doulas) do not arrive in time due to a failure to contact them in time, the remaining balance must still be paid.

  • If Blessed Birth Haven (RNs or Doulas) cannot attend your birth for reasons outside of their control (Hurricane, etc...), you may:

       1. Continue postpartum care and pay remaining balance minus labor support;         2. Cancel remaining services without further payment liability.

       3. If the client’s desired RN or Doula cannot arrive a substitute RN or Doula               may step in if available.

8. Arrival Policy

​​

  • ​Blessed Birth Haven staff or contractor will call or text the client upon their departure and give them their estimated time of arrival.  

  • ​Blessed Birth Haven staff or contractor will leave their current destination within the hour and has one hour to arrive at the client's birth location - Two hours total.

  • ​Blessed Birth Haven staff or contractor will only depart if the client is showing signs of active labor and is under no obligation to arrive prior to that point.  

  • Key Signs of Active Labor include:

  • Cervical dilation: 5 to 10 centimeters

  • Contractions: Last 45 to 60 seconds, every 3 to 5 minutes

  • Increased pain or pressure in the lower back or pelvis

  • Bloody show (increased vaginal discharge that may be tinged with blood)

  • Water breaking (if it hasn’t already occurred)

  • The mother may feel more intense discomfort and have difficulty talking through contractions.

  • The baby begins to descend into the pelvis.

  • Emotional shifts are common, and mothers may feel more focused, tired, or anxious.

  • It is generally recommended to call the doula once:

  • Contractions are 5 minutes apart, lasting 1 minute, and have been happening for at least 1 hour (this is known as the 5-1-1 rule).

  • The intensity of the contractions are greater than a 5 on a scale of 0 to 10

  • Water breaks

If the client experiences decreased fetal movement or heavy bleeding it is highly recommended that they go straight to the hospital or call 911.

9. Confidentiality & Privacy

​​​

  • We comply with HIPAA and Florida privacy laws.

  • Client records are maintained confidentially, disclosed only with written consent or as required by law.

10. Scope of Practice & Ethics

​​

  • Our team adheres to Florida’s Nurse Practice Act and relevant administrative rules.

  • We reserve the right to refuse or withdraw services if client's behavior is threatening, unsafe, abusive, or violates ethical standards

​11. Modifications

 

​Blessed Birth Haven may update these Terms; all clients will be notified prior to implementation.

Religious Purpose Disclaimer:

Blessed Birth Haven is a faith-based, religious nonprofit operating under Section 508(c)(1)(a) of the Internal Revenue Code. All services are provided in alignment with our sincerely held religious beliefs and principles rooted in biblical teachings. Our mission is to support women and families with compassionate, Christ-centered care through prayer, education, and support during childbirth.

Medical Services Disclaimer:

Blessed Birth Haven is not a licensed healthcare facility, birthing center, or medical provider. While our registered nurses and doulas are experienced and licensed where applicable, we do not offer emergency medical treatment, prescribe medications, or replace the role of your primary physician or licensed midwife. Clients must remain under the care of a licensed medical provider at all times.

Liability and Risk Disclaimer:

By receiving services through Blessed Birth Haven, you acknowledge and accept any and all inherent risks associated with natural birth, home-based care, or delayed medical interventions. You release Blessed Birth Haven, its staff, directors, and volunteers from liability for any complications, injuries, or outcomes arising from personal health decisions, religious convictions, or refusal of medical intervention.

IRS & Tax-Exemption Disclaimer:

Blessed Birth Haven operates as a 508(c)(1)(a) religious nonprofit and is not required to apply for 501(c)(3) status. Contributions made to this ministry may be considered tax-deductible; however, we recommend all donors consult their tax professional.

Fee-for-Service vs. Donation Disclaimer:

While Blessed Birth Haven is a nonprofit ministry, many services are offered on a fee-for-service basis. These fees compensate staff for their time and expertise and are necessary for operational sustainability. We also offer ministry-based services, prayer support, and resource guidance at no charge. Clients should not confuse fees for services with voluntary donations.

No Guarantee Disclaimer:

Blessed Birth Haven does not guarantee any specific outcomes related to childbirth, postpartum recovery, or infant care. Each experience is unique, and results vary based on numerous physical, emotional, and environmental factors.
